In fact, the Texas Tort Claims Act, which covers the liability of school districts, basically limits the liability of a school district to injuries or deaths caused by the operation or use of a motor vehicle, typically a school bus accident or an accident involving transportation of students to and from a school activity. There are exceptions to that general rule here in Texas, for example, there is some liability if you have a situation where a teacher has handed out excessive corporal punishment and in some circumstances, there’s liability where the student’s civil rights have been violated, but as a general rule, Texas gives broad immunity to school districts and if your child is injured in an activity that does not involve the operation or use of a motor vehicle, your rights may be quite limited.
