Title: International Economic Law by Other Means: Normative implications of Chinese Outbound Investments The role China plays in the changing ecology of international economic law (IEL) has been a source of great interest to the field. The emerging literature on China’s legal order argues that the novelty of China’s interaction with the existing legal order lies in the way that the country, while not abandoning the traditional IEL tools, such as preferential trade agreements and bilateral investment treaties, crafts alternative regulatory spaces and tools to accommodate its interests. This panel takes additional steps to unveil the features of Chinese approaches to IEL, by examining the legal tools mobilized to govern China’s foreign direct investment in differently positioned but nonetheless greatly impacted economies: Australia, Brazil, India, Nigeria, and Uzbekistan. The panel gathers a diverse group of IEL scholars with work experience in these countries. It focuses on the legal tools used to govern Chinese FDI in these jurisdictions and assesses theorizes on their normative implications for the discipline.
