Abbott | 560 U.S. 1 (2010) The Hague Convention on the Civil Aspects of International Child Abduction, which we’ll refer to as the Hague Abduction Convention, was adopted in nineteen eighty. Its purpose is to ensure that signatories respect each other’s child custody laws and that children wrongfully relocated by one parent are returned to their home country. In Abbott versus Abbott, we explore the convention’s scope. Timothy and Jacquelyn Abbott separated while living in Chile. A Chilean court granted Jacquelyn sole custody of the couple’s minor son and awarded Timothy regular visitation. Under Chilean law, Timothy’s visitation right triggered a ne exeat right requiring his consent before Jacquelyn could take the son outside Chile. While the Chilean proceedings were ongoing, however, Jacquelyn relocated the son to Texas. Once there, she filed a state court suit seeking unilateral control over the son’s place of residence and an order restricting Timothy to supervised visitation in Texas. Timothy subsequently filed suit in federal district court, asking the court to order the son’s return to Chile. He argued that return was required because the son’s removal violated Timothy’s ne exeat right, a right of custody, and was therefore wrongful under the Hague Abduction Convention. Jacquelyn countered that a ne exeat right wasn’t a right of custody, and its violation therefore didn’t support the return remedy. The district court held in Jacquelyn’s favor, and the Fifth Circuit affirmed. The United States Supreme Court granted cert to resolve a circuit split regarding the classification of ne exeat rights.
