Washington D.C. based military defense attorney David O’Dea of O’Dea Schneider PLLC explains Article 128 of the Uniform Code of Military Justice (UCMJ) which covers assault in the military - from simple fights between soldiers to more serious aggravated assaults. In this video, we break down what counts as assault under the UCMJ, why the military takes it so seriously, and the potential consequences for service members. At its core, assault is any attempt or offer to do bodily harm to another person, whether or not contact is actually made. This can include throwing a punch, pointing a weapon, or even threatening violence if it’s accompanied by the ability to carry it out. There are several levels of assault: Simple Assault – attempts or offers to cause bodily harm. Assault Consummated by a Battery – when actual unlawful force or violence is used. Aggravated Assault – assault with a dangerous weapon, or one that results in grievous bodily harm. This video is for general informational purposes only and does not constitute legal advice.
