STOP AND IDENTIFY LAWS I get a lot of questions about what information you are legally obligated to give to police if they ask you questions. Here are three things to know about Colorado’s “stop and identify” laws: 1) If you are driving and get pulled over for an alleged traffic violation, you are obligated to show the police officer your driver’s license, registration, and proof of insurance if they ask. Otherwise, you can politely decline to answer any other questions during the traffic stop. 2) If you are not driving and the police ever stop you – such as on the sidewalk or at a venue - you can politely ask if you are “free to leave.” If they say yes, then you can politely decline to answer any questions and go away. But if the police say you are not free to leave, that means you are being detained on suspicion of criminal activity. In that case, you do have to tell the police your name and address if they ask. And if they request to see your ID, you have to show it to them if you have it on you. But other than that, you can politely decline to answer any other questions during the detainment. 3) Refusing to give your identifying information to police during a traffic stop or detainment can be a contributing factor that leads police to arrest you for obstruction of justice. Otherwise, it is always recommended that you not speak to police any more than you have to because anything you say can be used against you. And if you give the police a fake name, you can be prosecuted for a misdemeanor or a felony depending on whether the false information substantially hindered their investigation.
