Another PTAB Flaw Revealed - Evidence Standard Needs Discovery and an Independent Judge

When questioned about the PTAB's preponderance of evidence standard vs the U.S. District Court's clear and convincing evidence standard, the witness conversation revealed that neither of these standards provide enough evidence for the truth—discovery is needed. Unlike the PTAB, a District Court provides the full benefit of discovery. Furthermore, when witness Joseph Matal discussed the problem with political interference at the PTAB, he said an independent, President-appointed and Senate-confirmed judge is needed. Representative Gohmert keenly pointed out that Mr. Matal made the case for using a U.S. District Court judge, as they are independent, President-appointed and Senate-confirmed, and the court is what was used prior to the passage of the America Invents Act (AIA)—the legislation that created the questionable PTAB. Representative Gohmert then provides some historical background how the AIA and the PTAB was sought to address "patent trolls", and that the AIA legislation didn't solve it, nor does it provide a faster, cheaper alternative to District Court.
