The Constitutional Court has heard that reasons offered by the National Assembly when it voted down the S89 independent panel report into the Phala Phala saga in December 2022 were not legally cognisable - and later reasons introduced by the ANC's Secretary-General Fikile Mbalula before the Constitutional Court to offer jusitification are "too little, too late". The Apex court is currently hearing the EFF's bid to revive the scandal that shook the nation by challenging the rationality of the National Assembly's 13 December 2023 decision to vote against the adoption of the report and effectively "blocked" a further probe against the President. Advocate Kameel Premhid on behalf of the EFF, opened his submissions to the court by dealing with the two bundles of reasons advanced before the court. One being reasons advanced by the then Minister of Justice in the parliamentary house at the time versus those advanced by the ANC SG to court.
