As the Cleveland Browns plan to build a new domed stadium in Brook Park, a lawsuit filed by the city will go before a judge this morning. The city filed the lawsuit back in January. Then in March, Haslam Sports Group filed a motion to stay or dismiss the proceedings. Today’s hearing will address that motion from the Browns. “For the past 26 NFL seasons, the Cleveland Browns have played their home games at Huntington Bank Field pursuant to a 30-year lease with the City of Cleveland,” according to the motion. “That lease expires after the 2028 season. The Browns have spent the last several years working to identify a home in Northeast Ohio to host their games long into the future. In that time, the Browns have sought to collaborate with the City to come up with a viable plan to fund a renovation of the lakefront stadium and necessary infrastructure improvements to integrate the lakefront with the downtown business district. But despite the Browns’ substantial efforts, a workable plan justifying the massive investment in a renovation of the existing stadium has not been developed.” The team argues the domed stadium option in Brook Park would provide “a multipurpose facility capable of attracting championship sports, concerts and other marquee events year-round.” “The City has opposed this alternative plan notwithstanding its potential to provide an economic boon to the greater Cleveland area,” their motion continues. “Seeking to hold the Browns hostage in an outdated stadium that is nearing the end of its useful life, the City last year threatened to invoke R.C. 9.67 --– the Modell Law -- to try to block a move to Brook Park.” In their motion, he team disputes use of the Modell Law as unconstitutional. “The Modell Law was plainly not intended to apply to a move like the one the Browns are considering – to another stadium on a site less than a mile from the city line, well within the team’s NFL home territory, after their current stadium lease expires.” The city’s lawsuit, however, says the Modell’s Law requirements “are straightforward.” “It provides that if a team takes taxpayer money and plays in a tax-supported facility, then the owner must either obtain the City’s authorization or give the City and others the opportunity to purchase the team before moving the team away from that facility. This common-sense response prevents owners from accepting taxpayer funding for a stadium only to turn around and unilaterally abandon those taxpayers and the stadium.
