If you are already entitled to spousal or divorced spousal benefits when you apply for your own retirement benefit, the “deemed filing” rule applies — meaning Social Security automatically considers both benefits at that time. However, if you are not yet entitled to a spousal or divorced spousal benefit at the time you file for your own retirement benefit (for example, your spouse or ex-spouse hadn’t filed yet), you would need to proactively apply later when you do become eligible. Additionally, survivor benefits (for widows, widowers, or divorced surviving spouses) are not subject to deemed filing. Survivor benefits are entirely separate and always require a proactive application when a spouse or ex-spouse passes away. It’s important to contact Social Security to review your eligibility whenever a major life event occurs (like a spouse filing or passing away) to ensure you receive the highest benefit available to you.
