It’s a serious issue, and there are serious penalties if someone is caught drinking and driving. Most impaired driving laws are based on a driver’s blood alcohol content, or BAC. A BAC of .08 is the line above which someone could be charged with criminal impairment. But it’s not necessarily safe to drive with a BAC below .08 — zero is the only truly safe number. For a first offense over .08, an impaired driver could face a fine of up to $1,000 and up to 10 years in prison. Those penalties escalate for repeated offenses or BACs over .12. Other penalties vary by province. In many cases, provincial penalties are for drivers between .05 and .08, known as the warn range. Though, the warn range varies in some provinces. For example, Ontario’s warn range is .05 to .079. A first offense in this range nets an impaired driver a three-day license suspension and a $250 fine. Subsequent offenses bring longer suspensions, higher fines, mandatory treatment, and even the requirement of an ignition interlock device. In Ontario, there are also additional provincial-level penalties for drivers convicted of criminal impairment. If the serious danger and the legal penalties aren’t enough, there are also car insurance implications for impaired driving charges. A conviction will certainly raise one’s car insurance premiums, and often makes it very difficult for them to find insurance at all.
