After the area in front of the courthouse had been violently cleared, law enforcement could have simply remained where they were, since there was no danger posed to anyone, but instead chose to escalate again. Note that prior to brutalizing the small crowd, many of which were sitting passively, they directly targeted the media and observers with tear gas to avoid documentation. After this was taken, these folks and others would be funneled to where Kyle Rittenhouse would shoot three people, killing two of them. There was no reason to have moved anyone from either the park in front of the courthouse or from the closed road next to it. Law enforcement created a shooting from a largely peaceful gathering, during a night where they knew that people had come to Kenosha specifically to target and shoot protesters.
