Police Body Cam Video Of Father Nearly Saving His Son From Arrest - On May 25, 2024, at approximately 1700 hours, two investigators with the Florida Fish and Wildlife Conservation Commission (FWC) were on water patrol in St. Andrews Bay, Bay County. They were patrolling near St. Andrews Marina when they observed a gray personal watercraft (PWC) with three individuals near the boat ramp. The operator, later identified through a Florida Driver’s License as a male, was wearing blue shorts and no shirt. The investigators saw the operator make a sharp turn near the dock, causing a passenger to be thrown into the water. The investigators approached the vessel to conduct a boating safety inspection and registration check. During the inspection, the operator was found to be without a boating safety card, current registration, a serviceable fire extinguisher, or a sound-producing device, and the registration numbers were improperly displayed. Due to vessel traffic, the investigators backed away to complete paperwork for the violations. While observing, they saw the operator jump into the water and then return to the PWC, which was taking on water. The operator was advised to bring the PWC ashore to prevent it from sinking in deeper water. He beached the PWC on the sand and attempted, unsuccessfully, to bail water out by hand. His behavior was noted as unusual. After the PWC was removed from the water, it was observed that water was pouring from the vessel, and another boater at the ramp reported a large hole in its bottom. The operator was pacing and using profanity. When questioned, one of the passengers mentioned they had been out on the island for six hours and that the PWC had been damaged previously. The operator confirmed the prior damage, explaining they had been at the island for a concert and recreational activities. A strong odor of alcohol was detected from the operator, who appeared upset and emotional. The investigators then transitioned the case to a Boating Under the Influence (BUI) investigation and asked the operator if he had consumed any alcohol, to which he denied. They proceeded with Standardized Field Sobriety Tests (SFSTs). During the tests, the operator displayed multiple signs of impairment, including a lack of smooth pursuit in both eyes and distinct nystagmus. His father arrived during the tests, interrupting with loud, profane outbursts, urging him not to comply with the tests. The operator also showed impairment during subsequent sobriety tasks, such as the Finger-to-Nose and Hand Coordination tasks, failing to follow instructions and perform the tasks correctly. His father continued to interrupt with profane language, further encouraging his son not to comply. Based on their observations and the results of the SFSTs, the investigators arrested the operator for BUI at approximately 1739 hours. He was transported to the FWC office, where he refused to provide a breath sample and was advised of the penalties for refusal. The Miranda Warning was read, but the operator declined to answer any questions. The operator passed out at the office for approximately 10 minutes. Photos were taken of the individual during this time. The operator was later transported to the Bay County Jail. He was issued a misdemeanor citation for operating a vessel while impaired, along with several infraction citations for refusal to submit to a breath test, not having a serviceable fire extinguisher, and other boating violations.
