In terms of drug crime, each different type of drug (whether it’s marijuana, cocaine, heroin, etc) has different threshold amounts. For example, despite the fact that marijuana is lawful in something like 30 states, in South Carolina it’s still very much illegal and we see a lot of marijuana possession cases. If a person generally has less than an ounce of marijuana, it’s considered just a Simple Possession. Greater than an ounce, many times the police will charge somebody with the crime of Possession with Intent to Distribute, which is a felony weight offense which carries up to five years in jail. And then Trafficking starts at 10 pounds. If a person has 10-100 pounds of marijuana, they’re charged with Trafficking. If a person has more than 100 pounds, it’s a higher-level of Trafficking. And in addition to that, for people that grow marijuana, we’ve seen cases where someone is charged with having more than 100 plants, and even though the plants were really small and the total weight of that was maybe only several ounces, that’s the equivalent of being charged with having over 100-1,000 pounds of marijuana. So, there’s a big issue in there in terms of what you can be charged with.
