SECOND DWI Arrest: • Extremely Intoxicated Woman With Shady Pas... Around 11:30 AM on August 21, 2024, Sergeant Justin Tracy with the Audubon Police Department responded to the parking lot of Acme at 100 E Black Horse Pike on a report of a female who was passed out behind the wheel. He arrived on scene led towards the vehicle by witnesses. He made contact with a female sitting in the driver seat of a silver 2023 Kia, and she appeared to be passed out. An open container of an alcoholic beverage was visible in plain sight on the front passenger seat. Sergeant Tracy awakened the female, and she was eventually identified as Erica. As he started speaking with Erica, Sergeant Tracy detected the odor of alcohol and observed other indicators of impairment. Based on his suspicion of impairment, Erica was asked to exit the vehicle and perform field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Erica did not touch heel-to-toe on each step and failed to follow instructions. After she continued to be uncooperative, Sergeant Tracy eventually terminated the tests and placed her under arrest for operating under the influence because she was in physical control of the vehicle. Her vehicle was impounded for a 12-hour hold according to John’s Law. Sergeant Tracy transported Erica to the Audubon Police Department for further processing. After the officers finished processing her, Erica was released to a sober adult pending her court appearance after he signed the Potential Liability Warning form on Erica’s behalf. Sergeant Tracy issued Erica the following citations: -Operating under the influence (39:4-50) -Careless driving (39:4-97) -Driving with a suspended license (39:3-40) -Open container (39:4-51B) Court records indicate that Erica has 4 other arrests for DWI prior to this video. Erica was later arrested for possession in Barrington, NJ on February 22, 2025.
