Kirksey | 8 Ala. 131 (1845) Canadian poet Robert Service once wrote, quote “Now, a promise made/ is a debt unpaid,” unquote. The defendant in the 1845 case of Kirksey versus Kirksey must’ve thought differently, because he didn’t take his promises very seriously. And unfortunately for his destitute, widowed sister-in-law, neither did the Alabama Supreme Court. Antillico Kirksey was a widow with several children. Her husband, Henry, had died in August 1840, along with one of their children. Antillico and her surviving children rented a residence and some farmland, hoping eventually to buy it. One day, her brother-in-law, Isaac, wrote her a letter. After offering his condolences, he advised her to sell her leasehold for whatever she could get for it, and then offered her a vacant home and farmland that he owned. Within two months, Antillico abandoned her leasehold, and moved her family into a comfortable home that Isaac provided. For two years, she and her family lived there and worked the land. That was until Isaac ordered her to leave. He sent her to live in an uncomfortable house in the woods, only to evict her from that residence shortly thereafter. Fed up, Antillico then sued Isaac for breach of contract in the Talledega County Circuit Court. A jury awarded her two hundred dollars, and Isaac then appealed the verdict.
