Superior Court | 578 P.2d 899 (1978) As states switched from common-law contributory negligence to modern comparative negligence, whether by judicial decree or by statute, questions regarding ancillary principles soon arose. In American Motorcycle Association versus Superior Court, the California Supreme Court addressed two of those principles, joint-and-several liability, and equitable allocation of liability among multiple tortfeasors. While participating in a novice-level, cross-country motorcycle race organized and run by the American Motorcycle Association, which we’ll call the AMA, teenager Glen Gregos suffered severe injuries rendering him permanently paralyzed. Glen sued the AMA for negligence in designing the course, administering the race, and failure to ensure that participants were adequately trained. The AMA responded that Glen’s own negligence was a proximate cause of his injuries. The AMA moved to file a cross-complaint against Glen’s parents for negligent supervision of their son and also sought to have any damages assessed against it reduced by the percentage of fault assessed against the parents. The trial court denied the AMA’s motion to file the cross-complaint. The AMA sought a writ of mandate from the court of appeal, which the court granted, ordering the trial court to accept the AMA’s cross-complaint. On its own motion, the California Supreme Court then took the case for consideration. Want more details on this case?
