United States | 519 U.S. 172 (1997) Imagine you’re on a jury deciding the fate of a defendant charged as a felon in possession of a firearm. During the proceedings, the prosecution introduces as evidence the nature of the defendant’s prior felony—aggravated assault. Would that information sway your verdict? Should that evidence even be admitted? The United States Supreme Court addressed this question in Old Chief versus United States. Johnny Old Chief was convicted in state court of assault causing serious bodily injury and was sentenced to five years in prison. After getting out of prison, he got into a fight during which a firearm was discharged. The evidence was disputed whether Old Chief, or someone else, had fired the gun. A federal prosecutor determined that Old Chief was the one who discharged the firearm and obtained an indictment from a federal grand jury charging him with offenses arising out of the fight, including the charge of being a felon in possession of a firearm. Old Chief pleaded not guilty and had a jury trial where he offered evidence that someone else possessed the firearm. During the case, the prosecution sought to introduce, as an exhibit, a copy of the state court judgment showing that Old Chief had been convicted of felony assault causing serious bodily injury and sentenced to five years in state prison. The defense objected to its admission and offered to stipulate to the simple fact that Old Chief had been convicted of a felony offense. The federal district court overruled the objection and allowed the prosecution to introduce the judgment. The jury convicted Old Chief, and he appealed. The United States Court of Appeals for the Ninth Circuit affirmed his conviction. Old Chief successfully petitioned the United States Supreme Court. Want more details on this case?
