Nearly half of all hospitalized patients and 70% of patients cared for in an intensive care unit will require the involvement of a surrogate decision maker. Patients who lose the capacity to make their own medical decisions either temporarily or permanently need an authorized decision maker to speak on their behalf. Patients can complete an advance directive to name a health care to be their authorized decision maker, but less than 30% of people complete advance directives. If a health care agent has not been named, then the Health Care Decision Act stipulates a prioritized list of individuals to serve as surrogate decision makers.
