To use the Taxpayer Advocate service, just complete Form 911 and submit. Let me tell you a few things about that service, and how it is commonly used. Watch to the end for the most important part. 1) It Is Good for Small, “Non-Mainstream” Problems. Occasionally, the IRS will allow miscellaneous tax problems to happen. These could include problems like mistakes or stolen identity on tax returns, or maybe tax returns that IRS cannot process. There may be situations where the IRS has charged more tax than expected. Sometimes the IRS cannot find a tax return or cannot locate your payment. This is just a small sample of problems the Tax Advocate helps with. Most often, these tend to be problems with tax liability for under $25,000. 2) The Service is Free, But Usually Slow One of the best features of the IRS’s Taxpayer Advocate Office is that it is free to you. The people within that Office providing the service are career IRS employees who understand the IRS’s inner workings. On the other hand, they receive hundreds, possibly thousands of requests every day. With that amount of volume, your case is not likely to move quickly. Also, while they use the name Taxpayer Advocate, they are still IRS employees. They solve problems but do not look for ways to further benefit you. 3) It is Not for Audits or Resolving Back Taxes. This Taxpayer Advocate service is not useful for payment plans and “resolution” of back taxes. Instead, for a problem in dealing with IRS Collection Officers, plus levies, or liens, you will probably need a good representative. This goes especially if the tax due is for payroll taxes, one of IRS’s collection priorities. IRS just does not provide free help for that problem. The same goes for IRS audits. The government does not provide free help to handle audits. Instead, for the best result, use a tax lawyer with IRS training.
