SHOPLIFTING LAWS The Colorado crime of shoplifting is knowingly taking merchandise from a store without paying. Under CRS 18-4-406, if a shoplifting suspect conceals the merchandise such as by hiding it under a jacket or in a backpack, that concealment is all the evidence a court needs to infer that the suspect intended to steal. Certainly, that makes it more challenging for defense attorneys to fight shoplifting charges. But there are still many effective strategies we can pursue to get shoplifting charges reduced or dismissed. Three possible defenses include: 1. There was no intent to steal, and the defendant simply forgot to pay, or someone planted the merchandise on him or her; 2. The defendant had already paid for the property, and the police made a mistake; or 3. The police violated the defendant’s rights by conducting an illegal search and seizure The penalties for a shoplifting conviction turn on the value of the merchandise. Taking less than $300 worth of goods is a petty offense, carrying up to 10 days in jail and/or $300 in fines. Taking at least $300 but less than $2,000 worth of goods is a misdemeanor, carrying up to 364 days in jail and/or up to $1,000 in fines. And taking at least $2,000 worth of goods is a felony, carrying 1 to 24 years in prison and/or $1,000 to $1,000,000 in fines.
