BEAUMONT - by Lauren Huet Tonight KFDM News has uncovered new developments linked to a special report we brought you earlier this year investigating a Beaumont Police Officer's use of force. We've learned a woman has filed a federal lawsuit against the officer claiming he violated her constitutional rights. "They tasered me twice in my stomach, twice, right here and right here. The police officer with the Taser gun in between tasering, lifted his Taser gun and punched me in the mouth and broke my tooth, and they both threw me onto the floor," said Krystle Bob. That's an excerpt from a special report we aired in January. Krystle Bob's lawsuit is against Beaumont Police Officer Joshua Dunahoe. She says his actions while investigating an anonymous call reporting a domestic disturbance at Bob's apartment were uncalled for. March 18th, 2014, two officers responded to Bob's apartment after an anonymous call from a neighbor. She declined to allow the officers inside the apartment. Bob told the officers she didn't feel comfortable with them coming inside, and she wanted to go back to sleep before going to work later that day. Audio tape from the officer's body microphone captured the exchange when he asked her to spell her first name. She had already told him her name and her driver's license number. Krystle: "I can write it down for you." Officer: "No, no, no, you're going to tell me." Krystle: "K-R-Y-S-T-L-E." Officer: "K-R-Y-S-T..." Krystle: "You remember what it is. You're a policeman, you have a very good memory. Do not touch me! Get off of me! Get off of me! Get off of me! Get off of me!" Second Officer: "Get back! Stay there!" Krystle: "Get off of me! Get off of me! Get off of me! If he takes his hands off of me I will calm down, I don't want his hands on me! Are you going to tase me? (Screams) Stop! My tooth! My tooth! You knocked out my tooth! Please stop!" Officer Dunahoe said in his offense report he began to arrest Bob for failure to identify. "And yet in this situation she did volunteer her name, and her driver's license number, and the police still came into her house without a warrant, without probable cause, and without any disturbance or anything else going on at the time," said Paul Gertz, Bob's attorney. Bob was charged with resisting arrest. The Jefferson County District Attorney's Office dropped the charge. Bob's attorney Paul Gertz says Officer Dunahoe violated Bob's right against an illegal search and seizure. The lawsuit claims Dunahoe unlawfully arrested Bob and used excessive force. City Attorney Tyrone Cooper says the city has no comment at this time. The Beaumont Police Department says its policy is not to comment on pending litigation. Gertz hopes the lawsuit sends a message to BPD. "That they need to train their officers better to respect the rights of citizens to be free from unreasonable searches and seizures in their homes, which the United States Constitution and the Bill of Rights guarantees," said Gertz.
