Social Justice is the part of Preamble and a Constitutional responsibility of Judiciary – Justice Madan B. Lokur Law College Dehradun has commenced its lecture series by eminent legal luminaries on 7th March, 2020 and had the privilege to invite Hon’ble Mr. Justice Madan Bhimarao Lokur, Judge, the Supreme Court of Fiji to deliver a lecture on the title, “Constitution and Social Justice”. The chief guest was given a cordial welcome with a memento by the Hon’ble Chancellor of the University Shri Jitender Joshi. The program was inaugurated with the lighting of auspicious lamp by the dignitaries followed by University Kulgeet. Principal & Dean Prof. (Dr.) Rajesh Bahuguna commenced the event by felicitating and apprising the students of the college, with the contributions of his lordship to the legal fraternity. Justice Madan Bhimarao Lokur, born on 31st December 1953, and graduated from Delhi University. He enrolled as an Advocate-on-Record in the Supreme Court of India, in the year 1981. During his entire tenure he served as the Standing Counsel for the Central Government, Additional Solicitor General of India, Additional Judge of Delhi High Court and Permanent Judge of Delhi High court, Chief Justice of Delhi High Court and Andhra Pradesh High Court, before being elevated as the Judge of the Supreme Court in the year 2012. He has a vast experience in Civil, Criminal, Constitutional, Revenue and Service Laws. His landmark judgements include Ashwani Kumar v. Union of India, Nipun Saxena v. Union of India, Rajendra Pralhadrao Wasnik v. State of Maharashtra etc. Dr. Rajesh Bahuguna extended his heartiest greetings to the Lordship, for his benign presence on behalf of the entire Uttaranchal University family. Hon’ble Justice Lokur began his discourse by thanking the management for organising such lecture sessions, as this would be the best way to educate the young minds. Quoting Dr. Rajendra Prasad he stated ‘Constitution to be a lifeless document and that one needs to breathe life into it by way of interpretation’. Justice Lokur focused his lecture on two aspects. First, where the law is present but executive is not implementing the same and the second is absence of law. His Lordship, threw light upon the Preamble of the Indian Constitution, and the intermingling of the principle of Separation of Power in Indian Scenario. He mentioned the three aspects of Social Inequalities concentrating on (1) Failure of Parliament to make laws; (2) Failure of the Executive to enforce the laws and (3) Social Problems having no Legislation. Beginning with the topic, Justice Lokur explained the rationale of judicial intervention in the method of governance for the sake of social justice which is the part of preamble and a basic feature of the constitution. He stated that, a citizen can’t be left without remedy, in case, the legislature and executive fail to deliver their constitutional responsibilities. “Social justice is the part of preamble, and primary responsibility of the judiciary is to ensure its proper implementation”, he further remarked. Hon’ble Justice cited many cases related to plight of widows at Vrindavan, treatment of prisoners, forced sterilization, child rights, human trafficking, rights of transgenders etc. and showed his concern on various aspects of social justice. Quoting Article 21 of the Constitution, he stated that every individual has not only right to life but right to live with dignity. Addressing the budding lawyers, his Lordship suggested for a better legal aid service and quicker disposition of cases. He concluded his speech emphasizing on the constructive interpretation of the Constitution and judiciary’s proactive role in handling the issue of Social Justice. In continuance of the discourse, there was an open session; his lordship took up questions from the students, teachers and journalists. This covered a spectrum of queries on criticism of judicial decisions, pending cases, judicial approach in Constitution Amendment Act, etc. and the response of the erudite personality, enlightened the young solicitors. Those present on the occasion were Chancellor of Uttaranchal University Shri Jitendra Joshi, Vice Chancellor Prof. N.K. Joshi, Dr. Rajesh Bahuguna, Principal & Dean, Mr. Kumar Ashutosh, Dr. Poonam Rawat, Dr. Jitendra Singh and a large number of students from ICFAI University, Graphic Era University, University of Petroleum and Energy Studies as well Uttaranchal University #uttaranchaluniversity
