[2014] UKSC 35 UKSC 2013/0048 R (on the application of T and another) (Respondents) v Secretary of State for the Home Department and another (Appellants) On appeal from the Court of Appeal (Civil Division) (England and Wales) This appeal relates to whether the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (SI 1975/1023) and Part V of the Police Act 1997 is incompatible with Article 8 of the European Convention on Human Rights (right to respect for private and family life). The Supreme Court unanimously (1) dismisses the Secretary of State's appeals against the declarations of incompatibility in respect of the 1997 Act; and (2) allows the appeal against the declaration that the 1975 Order was ultra vires.
