FULL SHOW NOTES BELOW... Are you at risk for termination of your disability benefits by Social Security? As difficult and time consuming as it may have been to win SSDI or SSI benefits, you could be subject to actions by the Social Security Administration to cut off your benefits and reverse their decision that you are "disabled." As I discuss in this video, there are two factors that SSA looks at in the months and years after you are approved. The first factor is your earnings. When you work - even if part time - your employer will report your earnings to the Social Security Administration. If you are self employed and you file tax returns, SSA will be informed about your gross earnings in a calendar year. If SSA's computer recognizes a pattern of on-going work activity, or if your earnings exceed #substantialgainfulactivity or "SGA" limits, your case may be flagged for a review. Secondly, SSA personnel review cases for termination where medical improvement is likely. Many medical conditions are curable with treatment and sometimes disability recipients have been prevented from pursuing treatment because of lack of money and lack of insurance. SSD benefits provide monthly income and access to Medicare and Medicaid - and SSA knows this. Further, the judge in your case may have noted in the favorable decision that medical improvement is likely and that SSA should re-evaluate in one year or three years. Note that a review - called a #continuingdisabilityreview - does not automatically mean that your benefits will be terminated. But you will be asked to complete forms and to give SSA access to your updated medical records. If you regain the capacity to work, you should - you will earn more money, you will feel more fulfilled and you will be more socially and intellectually stimulated. But if your disabling medical condition has not improved significantly you need to be prepared to prove that if SSA alleges otherwise.
