2017 Ninth Circuit Judicial Conference Korematsu: A Historical Overview This year marks the 75th anniversary of the signing of Executive Order 9066, which resulted in the mass incarceration of Japanese Americans, most of whom were U.S. citizens and the rest of whom were ineligible for naturalization by laws aimed at Asians. Those who defied the order were convicted of criminal charges. The Supreme Court rejected challenges to the order, upholding its constitutionality and the resulting criminal convictions. Forty years later, in cases involving Fred Korematsu, Gordon Hirabayashi, and Minoru Yasui, those Supreme Court rulings were challenged and the convictions were set aside through writs of coram nobis.
