IS IT LEGAL TO RECORD A CONVERSATION IN NEVADA? THREE THINGS TO KNOW: 1) Under NRS 200.650, recording someone in person is legal in Nevada if: • at least one party to the conversation consents to the recording, or • the conversation is not private Conversations are not "private" if they occur in public or other locations where there is no reasonable expectation of privacy, such as on a bus, in a restaurant, or in a stadium. 2) Under NRS 200.620, recording someone over the phone (called "wiretapping") is legal in Nevada only if all parties to the conversation consent to the recording. Therefore, there is a lower bar to record an in-person conversation, where you need the consent of only one participant, than there is to record a phone conversation, where every party to the call has to consent. 3) Under NRS 200.690, Nevada punishes illegal recording as a category D felony.
