False pleas are often taken (plaint, written statement or replication). The task of the Court is also multiplied. A case that could be decided in a short time then takes several years. The procedure is very long. Judge wants to decide the case at the time of final arguments even there is motivated false claim. What is the legal remedy? Section 209 of the Indian Penal Code provides a remedy for making false and dishonest claims in the court. This provision has been seldom used. Despite that, there are some rulings in which the courts have initiated the criminal proceedings for false claims and dismissed their case. It is the legal duty of every party to state in the pleadings the true facts and if they do not, they must suffer the consequences and the Court should not hold back from taking action. The faith of people in the judiciary can only be sustained if the persons on the right side of the law do not feel that even if they keep fighting for justice in the Court and ultimately win, they would turn out to be a fool since winning a case after 20 or 30 years would make wrongdoer as a real gainer, who had reaped the benefits for all those years. The presiding officer of a Court should not simply sit as a mere umpire at a contest between two parties and declare at the end of the combat who has won and who has lost and that there is a legal duty of his own, independent of the parties, to take an active role in the proceedings in finding the truth and administering justice. A judge in the Indian System has to be regarded as failing to exercise its jurisdiction and thereby discharging its judicial duty, if in the guise of remaining neutral, he opts to remain passive to the proceedings before him. He has to always keep in mind that "every trial is a voyage of discovery in which truth is the quest". Motivated falsehoods have to be appropriately dealt with, without which it would not be possible for any Court to administer justice in the true sense and to the satisfaction of those who approach it in the hope that truth would ultimately prevail.
