Kris explains the details from a conference call with a prospective client who had been sued over website accessibility. The client, a Shopify store owner, was seeking audit and remediation services to address their legal situation. The audit quote came in at $2,750 with a two-week timeline. Remediation was quoted at $12,500 with a two to three month timeline. Remediation involves fixing all issues identified in the audit and validating those fixes. For project insight, Accessibility Tracker was recommended as the platform for monitoring progress. The client would be able to log in as project manager and see exactly where the project stands, when it will finish, and generate progress reports based on actual audit results rather than scan data. The client had received another quote from a different provider offering a one-week remediation timeline. That is not feasible for a more involved Shopify store. When evaluating providers, attention to detail is key. If a provider is not being specific and detailed in their quote, that is a definite red flag. This particular store had significant content that needed remediation along with the code, making a one-week timeline completely unrealistic. Even though the client had in-house counsel, the recommendation was to contact an experienced defense attorney in the accessibility space. Even purchasing an hour of their time would be worth it as practical insurance. Being an attorney does not mean you understand how plaintiff law firms operate in this space. Experienced defense attorneys negotiate with these firms weekly and have valuable knowledge about minimums, settlement strategies, and which defenses to raise. Certification was also discussed. Certification can be valuable documentation when tied to strict WCAG conformance, but anyone can issue certification including a freelancer off Fiverr. Certification quickly loses freshness as changes are made to a website. What is even more valuable is user testing with documentation. A recorded session where a blind or visually impaired user accesses the website with a screen reader and relays their practical experience provides tangible evidence of accessibility that is hard to argue with. This takes place after validation and demonstrates commitment to accessibility. Most clients opt to handle remediation in-house with their existing developers. That is perfectly fine because validation happens either way. Typical Shopify store remediation takes a minimum of two months, usually quoted up to three because the time rarely goes faster than anticipated. When a quote is provided, that is the cost regardless of whether it ends up being more work than expected.Third-party integrations are an important consideration. If a review app or other integration has accessibility issues, those cannot be remediated without code access. You are generally responsible for what is on your website. The best practices for ADA compliance are WCAG conformance and a published accessibility statement with contact information. The more thorough and aggressive the approach, the better the outcome.
