In this video, we'll review highlights from Brett Favre's Response in opposition to Shannon Sharpe's Motion to Dismiss Favre's defamation lawsuit. First, Sharpe argued that his statements about Favre were opinions that cannot be proven true or false. Favre responded by pointing out that Sharpe's accusation that he "stole money" is a factual statement, not an opinion. Next, Favre argued that Sharpe's statements were not, as Sharpe claimed, "rhetorical hyperbole" protected under the First Amendment. Rather, Favre argued that Sharpe's statements created the impression that he committed a crime. Moreover, Favre argued that the First Amendment does not shield Sharpe's statements because Sharpe did not provide a complete disclosure of the factual sources on which he relied in making the statements. Favre also shot down Sharpe's argument that the case should be dismissed because Favre failed to give him at least ten days' notice of his defamation claim before filing suit. Favre pointed out that the statute requiring advance notice of a defamation claim only applies to radio or television stations "domiciled in [Mississippi]." At the end of this video, I share my final thoughts on Sharpe's Motion to Dismiss, Favre's Response, and my prediction of how the court may decide this Motion.
