Sant Date Reserved: 30th September 2024 Date Pronounced: 3rd December 2024 👥 Parties Involved Petitioner: Abhijit Ramrao Salunke (Grandson of deceased member Chhabubai Salunke) Respondent No. 1 & 2: Divisional Joint Registrar & Deputy Registrar of Cooperative Societies Respondent No. 3: Concerned Cooperative Housing Society (Owner of Plot No. 55) Respondent No. 4: Son of deceased Chhabubai (Uncle of the petitioner) ⚖️ Background of the Case Chhabubai Salunke, a member of the respondent cooperative housing society, was allotted Plot No. 55. During her lifetime: On 21.09.2019, she nominated her grandson (the petitioner), which the society accepted through Resolution No. 5. On 26.04.2021, she applied for the transfer of the plot and shares to the petitioner. The society approved this on 03.06.2021 via Resolution No. 4. After her death on 07.02.2022: Respondent No. 4 (her son) applied for membership twice, which was rejected by the society. He then approached the Deputy Registrar, who treated his application as an appeal and ordered that the petitioner’s membership be cancelled and granted to Respondent No. 4. The Divisional Joint Registrar confirmed this order, prompting the writ petition by the petitioner. 🔍 Issues for Consideration Whether the authorities under the Cooperative Societies Act can overrule society resolutions based on valid nomination and membership transfer? Whether nomination under Section 23 of the MCS Act is binding on the society? Whether questions of heirship fall within the jurisdiction of the Registrar? 📜 Findings of the Court The petitioner was validly nominated and admitted as a member based on Chhabubai’s application and subsequent society resolutions. The resolutions passed by the society were not challenged by Respondent No. 4. Section 23 of the Maharashtra Cooperative Societies Act permits a member to nominate and transfer shares/membership. Nomination is binding on the society. Disputes about heirship must be resolved in civil court, not by the Registrar. The decisions by the Deputy and Divisional Joint Registrar were held to be without jurisdiction. 📚 Key Case Laws Cited Indrani Wahi v.
