An Equity Buy-out Refinance is where one of the divorcing spouses wants to keep the marital home. So whomever is keeping the home would typically buy-out the other spouse. The buy-out is a special refinance loan. Typically in the Separation Agreement the financial terms of the divorce are agreed upon and stated in the Separation Agreement. Let's say the spouse leaving the marital home is supposed to receive $100,000 from the equity in the home. So the spouse staying in the home and refinances using the Divorce Equity buy-out and the $100,000 from the proceeds of the refinance we directly wired to to the bank account of the leaving spouse. Also, we have our title company pre-par either a Warranty Deed or Quit Claim Deed, to be signed by both the spouses. With the Warranty Deed or Quit Claim Deed, the leaving spouse is removed from the Deed and Title to the home.
