In this webinar, CTeL Policy Analyst Lydia and Research Analyst Sophie Fisher (JD) provide a high-level overview of the evolving legal landscape for telehealth, audio-only, and asynchronous (store-and-forward) care across the United States, drawing from CTeL’s forthcoming updated 50-state survey. The discussion highlights wide state-by-state variation in how telehealth modalities are defined, how practitioner-patient relationships may be established, and when audio-only care, questionnaires, and asynchronous tools are permitted. The presenters explore key post-2020 trends, including growing acceptance of audio-only services in certain contexts, increasing distinctions between static and adaptive questionnaires, and early state efforts to address artificial intelligence in healthcare. They also review examples of more restrictive and more permissive states, clarify how physical exam requirements differ, and explain why telehealth compliance is generally governed by the patient’s location rather than the provider’s.
