Decoding Section 377 and LGBTQ+ Rights I Legal-Sociological Perspective I Keshav Malpani

In this session, we will discuss the legal and sociological perspective of Section 377 in India and LGBTQ+ rights. We will also trace all the relevant case laws that shaped up the colonial law to be declared as unconstitutional in 2018. In Navtej Singh Johar v. Union of India (2018), Section 377 which prohibited carnal interncourse 'against the order of nature' was decriminalised by a constitutional bench of the Supreme Court. This was a major breakthrough for the LGBTQ+ community who have been discriminated for centuries. However, LGBTQ+ community still has a long way to go to be treated as equals in the society.
