In Episode 121, Calloway County workers’ compensation attorney Jeff Roberts provides a comprehensive guide to the various benefits available to injured workers in Kentucky. Drawing on 33 years of experience handling car wrecks, motorcycle accidents, and workplace injury claims, Jeff explains the specific types of coverage you are entitled to, from medical expenses to permanent disability and vocational retraining. What Qualifies as a Work-Related Injury? In Kentucky, benefits are not limited to sudden accidents; they also cover conditions that develop over time: • Cumulative Trauma Injuries: These repetitive motion injuries, such as carpal tunnel or shoulder damage from lifting, qualify for benefits even if they weren't caused by a single incident. • Pre-Existing Conditions: If a "dormant" condition, like degenerative disc disease, is aggravated or accelerated by your work activity, it can qualify as a work-related injury. • Occupational Diseases: Coverage includes respiratory diseases, cancer, heavy metal poisoning, and potentially communicable diseases like COVID-19. Jeff is currently involved in a case before the Kentucky Supreme Court regarding how COVID-19 should be treated under workers' comp. • Hearing Loss Requirements Hearing loss is treated differently in Kentucky. To qualify for permanent disability benefits, you must have an impairment rating of 8% or higher. However, even if you do not meet that threshold, you may still be eligible to have related medical expenses covered, such as cochlear implants. Types of Workers’ Compensation Benefits • Medical Expenses: 100% of your medical bills related to the work injury are covered, with no deductibles or copays. This can include prescriptions and treatments for 15 years or even a lifetime in certain cases. • Mileage Reimbursement: You can be reimbursed for travel to see specialists using Form 114, provided you submit it within 60 days of the expense. • Temporary Total Disability (TTD): If a doctor orders you off work for more than seven days, you may receive 66 2/3% of your average weekly wage. If you are off for 15 days, you can also be paid for the initial seven-day waiting period. • Permanent Disability (PPD & PTD): If you have a permanent impairment, benefits are calculated based on your impairment rating, age, education, and ability to return to your previous job. Permanent Total Disability benefits can continue until age 70. • Vocational Rehabilitation: If you cannot return to your original field, you may qualify for 1-2 years of paid retraining or trade school.
