Is it possible? Yes — as long as both investors meet key requirements. 1. Ownership Structure To qualify two investors for two E-2 visas: Each investor must own exactly 50% of the business. No third owners allowed — not even 1%. Control is shown through negative control provisions in the operating agreement. 2. Separate Sources of Funds: Each investor must have their own independent source of funds. Examples that work: Investor 1 receives a gift from a family member Investor 2 sells a property they personally own Examples that do not work: Investor 1 giving Investor 2 money to invest Joint/shared accounts used as a single source Each investor must prove their own money trail. 3.
