One ordinary afternoon, Mrs. Wilkinson received shocking news from a man name Downton. He told her, with a serious face, that her husband had been badly injured in an accident and was lying in a hotel with broken legs. But it wasn't true. Downton thought if would be a harmless joke. But for Mrs. Wilkinson, it wasn't funny. The emotional shock sent her into real distress, vomiting, sleeplessness, and weeks of nervous suffering. THE LEGAL TWIST: Even though there was no physical harm and no intent to injure, the court held Mr. Downton liable. Why? Because: 1) He made a statement he know would cause shock 2) She suffered real emotional and physical consequences This case became a foundation for what we now call intentional infliction of emotional distress (IIED).
