Downton | [1897] 2 Q.B. 57 Historically, tort law was hesitant to recognize liability for causing another purely mental harm. But in Wilkinson versus Downton, an English case from the late nineteenth century, the court explored whether tort liability for such harm is sometimes appropriate. Charles Downton, a regular patron of a London pub, played a practical joke on the pub’s landlady, Lavinia Wilkinson. Downton told Wilkinson that her husband needed urgent help because he’d been seriously injured in an accident, breaking both his legs. Wilkinson immediately sent her son and a servant by train to her husband’s purported location. Upon arrival, it became clear that Downton’s story was false. Despite Wilkinson having no previous physical or mental ailments, Downton’s message was such a shock to her nervous system that she suffered long-term incapacitating illness requiring medical attention. Wilkinson filed a tort suit against Downton in the Queen’s Bench Division of the High Court, alleging fraud and seeking to recover the cost of the unnecessary train fares plus one hundred pounds for her illness and suffering.
