The case is about a city in Texas denying a special use permit for a home for mentally retarded people due to a zoning ordinance. The Court of Appeals said the ordinance did not uphold the Equal Protection Clause as the mentally retarded classification is "quasi-suspect." However, the Supreme Court said the ordinance is invalid, although the mentally retarded classification is not a suspect classification. The District Court said the ordinance and its application are constitutional because mental retardation is neither a suspect nor quasi-suspect classification. The Court of Appeals disagreed and found the ordinance invalid. The Supreme Court analyzed whether the ordinance deprived the respondents of equal protection of the laws. City of Cleburne v.
