The case is about a city in Texas denying a special use permit for a home for mentally retarded people due to a zoning ordinance. The Court of Appeals said the ordinance did not uphold the Equal Protection Clause as the mentally retarded classification is "quasi-suspect." However, the Supreme Court said the ordinance is invalid, although the mentally retarded classification is not a suspect classification. The District Court said the ordinance and its application are constitutional because mental retardation is neither a suspect nor quasi-suspect classification.
