On December 6, 2025 at approximately 2:08 AM, Officers Francisco Silva and Stephen Molenda with the Villa Park Police Department were parked in front of 321 E Kenilworth Avenue, near DeMito’s Saloon. They were there for bar checks, and Officer Silva heard a loud noise of some kind of metal being struck by another vehicle. He noticed a tan 2015 Lexus GX coming off from the curb while covered in snow, and the vehicle nearly struck his squad car. The Lexus later continued northbound on Villa Avenue, and it was later determined that the driver had struck a road sign. Officer Silva activated his emergency lights to initiate a traffic stop, and the driver pulled over in the vicinity of Villa Avenue and Wildwood Avenue. He exited his patrol car and made contact with the driver, who was later identified as 23-year-old Victoria Rutkowski. Victoria initially claimed that she was heading home from work in Oak Brook. As he was speaking with her, he detected the odor of alcohol and observed other indicators of impairment. Victoria was having trouble locating of her documents, and admitted to consuming 2 shots of alcohol earlier that evening. Based on his suspicion of impairment, Officer Silva decided to administer field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Officer Silva observed the lack of smooth pursuit and distinct and sustained nystagmus at maximum deviation. He also observed vertical nystagmus in both eyes. The second exercise was the Walk and Turn test. During the Walk and Turn test, Victoria did not touch heel-to-toe on each step, turned improperly, and took an incorrect number of steps. The final exercise was the One Leg Stand test, and Victoria failed to raise her foot in the proper fashion and put her foot down before the test was complete. Following the field sobriety exercises, Officer Silva brought over the PBT machine, and the results indicated a BAC level of 0.232%. Based on her erratic driving, the odor of alcohol, her admission to drinking earlier that evening, and her inability to adequately perform the field sobriety exercises, Officer Silva placed Victoria under arrest for driving under the influence. Victoria was transported to the Villa Park Police Department for further processing. She agreed to submit breath samples at the station. Her breath test results indicated a BAC level of 0.221%, which was nearly triple the legal limit of 0.08%. After they finished processing her, Victoria was released pending her court appearance. Victoria was charged with the following: -DUI - BAC .08 or more - 1st offense (625 ILCS 5/11-501(a)(1)) -DUI - Alcohol – 1st or 2nd offense (625 ILCS 5/11-501(a)(2)) -Fail to give any information to owner after striking unattended vehicle or property (625 ILCS 5/11-404(a)) -Operating an uninsured motor vehicle (625 ILCS 5/3-707(a)) ------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
