The United States District Court for the Eastern District of Tennessee just handed down a devastating Preliminary Injunction against Timothy Hoffman and Hoffman Tactical. Despite the evidence, Judge Curtis L. Collier sided with ABC IP and Rare Breed Triggers, effectively banning the distribution of the "Super Safety" design. In this video, we break down this ruling. ⚖️ WHAT HAPPENED? The court largely adopted the Plaintiffs' version of the facts, ruling that the Super Safety likely infringes on ABC IP’s patents, specifically the '247 and '784 patents. The judge has ordered Hoffman to: Stop selling or offering the "Super Safety" kits. Wipe all files (CAD, STEP, and 3D print files) from Odysee and all other public platforms. Cease all licensing and promotional activities for these designs. We look at how the court dismissed the defense's arguments and how the USA's "Statement of Interest" played a role in swaying the "public interest" factor heavily in favor of the injunction. The court claims Rare Breed is suffering "irreparable harm" because they are losing $350–$425 per unit in potential royalties and profits. But is it fair to crush an innovator over "difficult to quantify" damages?. 🚩 THE CONSEQUENCES This isn't just about one guy in Tennessee. The court found that because Hoffman's files are already being used for manufacturing as far away as China, a total shutdown was "necessary". They even kept the bond at a measly $20,000, despite Hoffman’s team previously estimating potential losses of $80,000 in a single day of sales.
