Factual Background The flat was originally allotted to Mr. Vishnu Waghmare under a Slum Rehabilitation Scheme. The Petitioner entered into a registered Leave & License Agreement (L&LA) claiming to have paid a cash deposit of ₹20 lakhs. Subsequently, Waghmare sold the flat to Respondent No. 7 without repaying the Petitioner. The Petitioner filed appeals against eviction notices under Section 33 of the Slums Act, which were rejected by the Deputy Collector and AGRC. The Petitioner approached the High Court challenging these orders. Court's Findings Section 3E of the Slums Act continues to apply even after the 10-year lock-in period: The tenement does not automatically become freehold. Any transfer still requires SRA permission, even post-lock-in. Unauthorized transfers—by way of sale, lease, or license—are void without SRA approval. Petitioner’s possession was illegal: No permission was taken from the SRA. Registered L&LA based on a cash transaction was held invalid and unenforceable. Rent Control Act does not override Slums Act: Slums Act (amended in 2012) is a special, later legislation, and prevails over the Maharashtra Rent Control Act, 1999. Section 47 of the Rent Act does not bar SRA action under Section 33. Cash transactions over ₹2 lakh: The Court directed the Income Tax Authority to investigate the ₹20 lakh cash deposit cited in the L&LA. Compliance report is due by 31 January 2026. Misuse of legal process: The Court held the Petitioner’s action as an abuse of process aimed at delaying and extracting money from the bona fide purchaser.
