Yes, the exact apartheid era law that was repealed in 1991. This shocking revelation came after NEASA received a letter from the Department confirming that employers should rely on the repealed Act as a guide for deciding employee racial categories. This raises a major question. Why is the government reaching back into apartheid legislation to enforce modern racial quotas under the Employment Equity Amendment Act of 2023? The answer is simple. The state has no lawful or constitutional mechanism for classifying people by race, yet it demands strict compliance with race based sector targets. Instead of taking responsibility for this legally risky process, the government is attempting to shift the burden onto businesses, leaving employers exposed to fines and penalties that can reach millions of rand. Under the new Employment Equity quota system, companies must limit certain racial groups to specific percentages, including white men being capped as low as four percent in some industries. Employers must submit accurate racial, sex, and disability data to the Department, yet employees are not required to self identify. This creates a catastrophic legal trap.
