In this episode of Newsflash, Joe Emilio breaks down how a series of existing laws and proposed Bills are slowly eroding private property rights in South Africa, not through revolution or chaos, but through legislation and parliamentary process. Two of these laws are already in force. The Prevention of Illegal Eviction Act, known as the PIE Act, has made it nearly impossible for landowners to protect their property from unlawful occupation. Over time, this has allowed informal settlements to mushroom while property owners become trapped in endless legal battles, often giving up entirely. Then comes the Expropriation Act. This law allows the state to expropriate land in the public interest, which explicitly includes land reform. It also introduces the concept of abandoned land, opening the door for property to be taken when owners can no longer effectively exercise control over it. But the story does not end there. In a recent parliamentary session, a minister openly admitted that the government is facing resistance from landowners, particularly in the Western Cape, who are unwilling to give up their land for redistribution. Instead of recognising this as a basic property right, the government’s response is to push for new legislation to fast track redistribution. That is where the Equitable Access to Land Bill and the Communal Land Tenure Bill come in. These two Bills are currently being discussed in Parliament. While they are not yet law, the intent behind them is clear. The Equitable Access to Land Bill is designed to accelerate redistribution using vague criteria such as equity, redress, and historical injustice. The Communal Land Tenure Bill governs what happens after land is redistributed, and in previous versions, it removes private ownership entirely, replacing title deeds with state or traditional authority custodianship. When these laws and Bills are viewed together, they form a pipeline. Illegal occupation creates abandoned land. Expropriation allows the state to take it. Redistribution reallocates it. Communal tenure ensures the state retains ultimate ownership. This episode connects the dots, explains the legislative process in simple terms, and examines why this approach aligns closely with the ANC’s National Democratic Revolution ideology. It also explores why history shows that state custodianship of land leads to economic decline, reduced investment, and loss of individual freedom. This is not speculation. It is based on legislation, parliamentary records, and statements made openly in Parliament.
