In her webinar, titled “School Exclusions: Pupils with SEND”, Trinity Employment, Discrimination and Education Barrister, Helen Hogben, discusses the legal obligations of schools towards children and young people with special educational needs and disabilities (SEND) when considering whether to permanently exclude a pupil. In the UK, children and young people with an EHC (education, health and care) plan are almost four times as likely to be permanently excluded from school than non-SEND pupils. Helen’s talk focusses on maintained schools and academies (as opposed to independent schools), with reference to relevant case law and government and legislative guidance. Topics covered include: The statutory guidance and schools’ wider legal obligations The definition of ‘disability’ Discrimination arising from disability Exceptions under the Equality Act (Disability) Regulations 2010 Common discrimination claims at SEND tribunals Next steps after permanent exclusion Challenges to governing body conclusions and applications to the IRP There is a handout that accompanies the session.
