Collaborative Family Attorney and Marketing Master Joryn Jenkins of Open Palm Law explores Collaborative Divorce, a cutting-edge approach to divorce that avoids the destructive impact that litigation has on a family. Specifically structured to ensure productive, respectful, and efficient conversations between the spouses, the collaborative objective is to produce an agreement that meets each person’s needs, and those of any children, within a safe and confidential setting. This enables a couple to end their marriage legally, financially, and emotionally, without sacrificing valuable relationships, as so often happens in court. Collaborative practice is premised on three principles: 1) the spouses’ and their attorneys’ pledge not to go to court (i.e. to war); 2) their adherence to an open and transparent, but private and confidential exchange of information; and 3) solutions customized by the clients to account for the highest priorities of the adults, their children, and any other interested parties. Each client retains a lawyer, as well as a team of other professionals who are all neutral, usually a financial expert, at least one facilitator, and sometimes a child specialist. Once engaged, the team moves forward with a series of non-confrontational meetings, between each spouse and each neutral professional, between each spouse and his or her attorney, sometimes between both spouses and each neutral professional, and almost always of the full team, everyone mentioned above. Collaborative meetings focus on the shared primary goal of finding solutions that are acceptable to both spouses. The process does not rely on court-imposed decisions but instead permits the clients to negotiate in a safe and structured atmosphere of honesty, cooperation, integrity, and professionalism geared toward the future well-being of the restructured family. A collaborative divorce saves you time and money, prevents emotional trauma to you and the ones you love, ensures results personalized to your unique family, and protects your relationships with everyone around you.
