LEBANON, Ohio (WKRC) - Too weak to be a threat, or too dangerous to be out of jail? Those were the questions considered Monday in juvenile court about a 16-year-old accused of murder. The bailiff calls the court to order, “Warren County juvenile court in session. The Honorable Judge Kirby presiding,” he barks. Logan Dean, the subject of the hearing, was excused from appearing due to his weak condition. Dean's attorney tried to convince the judge his client shouldn't have to be in juvenile detention while awaiting trial either, due to the gunshot injuries he received in the alleged botched robbery. “He should be released to the custody of his grandmother because there are less restrictive means of monitoring him,” said John Kaspar, Dean’s attorney. But the prosecuting attorney argues the request was less about health and more about not wanting to be in juvenile detention. “This is a murder charge,” said Julie Kraft. “For the protection of the community, for the protection of himself, this is exactly where he needs to be at this point in time.” Local 12 spoke with Dean’s uncle outside the courtroom. “The prosecutor was wrong,” says Michael George. “[Logan’s] not a threat to anybody in the community." Dean's uncle says his nephew is too weak to be a danger to anyone. The shooting took one of his kidneys and part of his liver, and he needs medical and mental care due to a poor upbringing. "My parents took custody of him when he was 5 or 6 years old. He did not have a good childhood coming up. He was around drugs and alcohol. His parents taught him wrong, and I believe it’s messed him up,” he said. And Dean's uncle admits his nephew messed up when getting involved with kids he shouldn't have. Police say in December, Dean and four other teens lured a man to a home on Oregonia Road in Turtlecreek Township, attempted to kidnap and rob him and the man shot two of them in self-defense. “The kid’s 16. He’s traumatized. He watched his best friend die in front of him. So, what kid would be OK in a situation like that?” Dean’s cousin, Alanta George, said. Alanta and another cousin say Dean told them the other teens didn’t say where they were going that night when his friends asked him to go for a ride. “If Logan had knew that this was happening, he never would’ve gone,” said Tessa George. But he did go, and the judge says he's where he needs to be right now. "I have to err on the side of caution,” said Judge Joseph Kirby. “And that caution tells me he needs to remain in the detention center.” Of the five teens involved in this alleged plot to kidnap and rob the man, one is dead -- Mason Trudics. The other four are being charged for his murder, three of which are juveniles. They are waiting to hear whether they will be tried as adults. The victim of the failed robbery attempt, the man who apparently shot both teens, remains anonymous and uncharged. Police say acted in self-defense.
