MINOT, ND - Just after midnight on New Year's Day 2020, Ward County sheriff deputies received a call from an Uber driver who claimed a lady was passed out at a light at a busy intersection in town. The deputy discovered the suspect passed out as she struggled to answer questions and did not know how many drinks she had had in the night. When the EMTs spoke to the suspect, she had stated that she had been drinking earlier in the night. While coming home after a night out at the bars on New Year's, the driver admitted to drinking heavily and being too tired to drive home. While a medical evaluation was being performed, the deputy found multiple empty bottles of liquor as well as open containers in the suspect's vehicle. While escorting the suspect from the ambulance to the deputy's cruiser, the deputy observed swaying and the inability to balance while walking. During the field sobriety tests, the suspect reaffirms she had drank seven White Claws throughout the night. The suspect claimed that she was not feeling intoxicated, but tired only. The suspect was unable to follow the deputy's finger during the horizontal gaze test [out of frame, redacted] smoothly. A distinct jerking motion was observed at maximum deviation. The officer next asked the suspect to recite the entire alphabet which the suspect was not successful during her first attempt replacing the letter "V" with "B" before stopping. The suspect did not follow instructions properly when asked to count from 56 to 72 by starting with the number "57." The suspect was next asked to count backwards from 74 to 53 during which she recounted multiple numbers and skipped several others. The suspect also forgot when to stop her count. At this time, the deputy informed the suspect that North Dakota law required a screening test in order to drive in the state and a refusal would cause a suspension of 180 days. After performing the screening test, the suspect blew .186% BAC and was subsequently arrested for Actual Physical Control (APC) which is the immediate control or having the ability to operate the motor vehicle while being under the influence or having a blood-alcohol concentration of .08 percent or more. Upon arrival at the Ward County Detention Center, the suspect performed an evidentiary breath test which registered .175% BrAC.
