Or even if you are experienced and think you have it figured out - the planning system has a way of scuppering even the best laid plans. So, in this video, I am going to show you the best ways of getting planning permission even if you have been refused planning permission. I will be running through 3 options and the pros and cons of each. I am also going to give you a bonus 4th option so make sure you stick around for that at the end. You may not know this but there are a lot of options available even if I have been refused planning permission. I have come across all types of strategies and tools when it comes to using the planning system to make us much profit for property investors as possible. Appeals are an area of planning where so much value gets left on the table - so this video will give an insight into the options available to you. If I have been refused planning permission, my first port of call would be to re-submit the application. Did you know you can re-submit your application that has been refused? For FREE? Most people aren’t aware that you have the ability to re-submit an application even if I have been refused planning permission. So if your application has been refused for a single storey rear extension with a pitched roof say, you can re-submit for the same thing with a flat roof for free. The big pro of this option is that it is free. You don’t need to pay application fees again. It is also quite likely that you will get the same officer which means they will know your site and proposal already so will be able to give more certainty on the outcome of your next application. The downside to this option is that you have to go through the local planning authority to get permission. And depending on how long it took to get your original refusal, that could take a while. This ONLY works for planning applications. Another option you have at your disposal is to go for pre-application advice. If you have been refused and your officer has been difficult to get hold of, then you can formalise the process and go for pre-application advice. If I have been refused planning permission, I would NOT do this. The third option you have is that you can appeal against the refusal. Once you receive the decision, you have 12 weeks (for householder applications) or 6 months (for all other applications) from the date of the decision to appeal. There are some major PROS to using this option. The first is that appeals are free. There is no cost to appeal the decision. You may incur costs of consultants if you use them but otherwise there is no cost. The other PRO is that you are likely, in some instances, to get a fairer decision making process. Some Councils, not all, sometimes make unfair decisions. This can happen at every level from the major to the very minor applications. The CON with this option is that the Planning Inspectorate (the people you appeal to) are just as busy and resource-stretched like local planning authorities. So decisions are taking longer and longer to be issued. But it will likely be a lot quicker than if you were to re-apply for planning permission. So if I have been refused planning permission - appealing the decision may be fruitful! The last option is for those still waiting for their decision. If you haven’t received your decision and are still waiting, you have the ability to appeal against non-determination. If your decision has not been made, within 8 weeks of being validated then you can appeal the decision. Even if you think you are expecting the decision soon, you have this option in your back pocket in case the authority drags their feet.
