The legal case regarding the application of the  Old Pension Scheme (OPS) for Central Armed Police Forces (CAPF) personnel is currently pending in the Supreme Court of India.  Key developments in the case: Delhi High Court Ruling: In January 2023, the Delhi High Court ruled that the CAPF are "Armed Forces of the Union" and thus, all their personnel are entitled to the benefits of the Old Pension Scheme, as they were excluded from the New Pension Scheme (NPS) notification of December 22, 2003. Supreme Court Stay: The Union Government challenged this decision in the Supreme Court. In response, the Supreme Court, in an interim order, stayed the Delhi High Court's verdict in July/August 2024. Current Status: The case is still under legal consideration, and a final judgment is awaited. The stay order means that, for now, the Delhi High Court's direction to apply OPS to all CAPF personnel is not in effect across the board.  However, the Supreme Court did clarify that government employees who were recruited based on advertisements issued before the notification of the NPS (i.e., on or before December 22, 2003) can still opt for the OPS, as per an existing government office memorandum.  The matter has been listed for further hearings, with proceedings ongoing to determine the final applicability of the OPS to CAPF personnel.  CAPF stands for Central Armed Police Forces, India's seven specialized paramilitary forces (like BSF, CRPF, CISF, ITBP, SSB, Assam Rifles, NSG) operating under the Ministry of Home Affairs, responsible for internal security, border guarding, anti-insurgency, VIP protection, and disaster relief, playing a vital role in national security and law & order, with recruitment often through the UPSC CAPF exam.  Key Aspects of CAPF: Role: Maintain law & order, secure borders, counter terrorism, protect critical infrastructure, assist in disaster management.
