The Court held that lack of menstrual hygiene facilities in schools creates structural inequality and forces girl students into absenteeism or drop-outs. Issuing a continuing mandamus, the Court directed the Centre and States to provide free sanitary napkins, functional gender-segregated toilets, and safe disposal mechanisms in all schools, including private institutions. It clarified that “free education” under the RTE Act, 2009 also means removing financial and infrastructural barriers that hinder education.
